The Spanish Trade Secrets Law 1/2019 protects your confidential information as long as it has value because it is secret and you adopt reasonable measures to keep it that way. Certifying its existence with a certain date documents that diligence and proves what information you held and since when.

Questions about secrets and assets

Do I have to upload my confidential information?

No. You can certify only the hash (the fingerprint) of your file, computed on your machine. Safe Creative records that fingerprint with a certain date, but the content never leaves your environment. It is the essence of the Zero-Knowledge protocol.

How do I later prove the secret is mine?

The day you need it, you present the original file. If its hash matches the certified fingerprint, it is proven that that exact content existed on the date of registration and has not been altered.

Is this the same as a patent?

No. It is proof of existence and certain date that helps protect your information as a trade secret, which is a right distinct from a patent. A patent protects inventions but requires publishing them; a trade secret protects know-how while it is kept confidential. It does not replace advice from an industrial property agent.

How does it fit with the Trade Secrets Law?

Law 1/2019 protects secret information if you adopt reasonable measures to keep it secret. Certifying its existence with a certain date documents that diligence and proves what information you held and since when, strengthening your position in a leak or dispute.

Which plan is it available in?

Registering assets and secrets under a Zero-Knowledge protocol is included in the Business plan and above. You can also integrate it into your systems via the API.

Can I automate it in my systems?

Yes. Through the API you can seal the fingerprint of your files, backups or releases from your own workflows, sending only the hash. It is a professional route with terms by agreement.
